These Terms & Conditions (“Terms”) govern all services provided by TrueView Nayarit (“the Company,” “we,” “our,” or “us”) to any client (“Client,” “you,” or “your”). By requesting, booking, or paying for any service, you acknowledge that you have read, understood, and agreed to these Terms.

1. Scope of Services
TrueView Nayarit provides non-invasive, visual home checkups, reporting, and communication services for residential properties in Nayarit. Services include:

Scheduled recurring checkups

Photo/video documentation
-
Property condition reports
-
Emergency checkups (visual inspections only)

Optional labor-based add-on tasks when appropriate and safe
Limitations:

We do not perform specialized trade work (plumbing, electrical, roofing, etc.).

We do not guarantee prevention of loss, theft, damage, or weather impact.

We do not provide property security, surveillance, or 24/7 monitoring.

Checkups are visual in nature and non-destructive; we do not move heavy objects, dismantle structures, or access unsafe areas.
2. Scheduling and Access Requirements
2.1 Regular Checkups
Checkups are performed within predefined scheduling windows. Exact times may vary based on routing, safety conditions, weather, and client priority levels.
2.2 Access and Entry
Clients must provide working keys, codes, lockbox access, or personnel coordination. If we cannot access the property due to missing or malfunctioning access, the checkup is marked as Attempted – Not Completed, and the visit is considered fulfilled.
2.3 Unsafe Conditions
If forced entry, active break-in indicators, or dangerous conditions are observed, the inspector will not enter the property until cleared by relevant authorities. This policy is non-negotiable.
3. Service Limitations and Exclusions
The following are explicitly not included unless separately authorized:

Repairs, cleanup, or remediation

Pest removal or wildlife handling

Climbing on roofs or ladders
-
Mold testing or structural assessments
-
Third-party hiring, vendor management, or financial transactions on your behalf
Any task falling outside normal operating scope may be declined at the Company’s discretion.
4. Client Responsibilities
Clients agree to:

Provide accurate information about the property.
-
Maintain safe, legal, and accessible conditions.

Store keys and access tools responsibly.
-
Ensure utilities (water, electricity) are functional when tasks require them.

Pay all invoices on time.
Clients remain fully responsible for the property and its condition between visits.
5. Emergency Services Policy
An “emergency checkup” is a priority visual inspection requested outside regular scheduling.
Emergency services do not include repairs or physical intervention.
We do not guarantee immediate response times, but we prioritize emergencies as operational capacity allows.
If a situation is life-threatening or involves suspected criminal activity, clients must contact local authorities first.
6. Billing and Payment Disclosures
Website pricing reflects standard service rates for typical single-residence properties.

Recurring Checkups
Clients prepay monthly or by term. Discounted rates apply for higher frequencies.
Labor-Based Add-Ons
Estimated monthly hours may be provided; a security deposit may be collected; actual hours are billed at month-end.
Minimum labor charges apply:

15-minute minimum when labor occurs during an already-scheduled checkup

1-hour minimum when labor occurs outside a scheduled checkup
-
1-hour minimum for all emergency labor, regardless of checkup status
Emergency Services

Emergency checkup during business hours: MXN 1,200
-
Emergency checkup after hours: MXN 2,400
-
Emergency labor during business hours: MXN 350/hr
-
Emergency labor after hours: MXN 700/hr
6.2 Additional Pricing Notes
Prices on the website are for informational purposes and may vary based on property complexity, distance, or additional client requests.
All binding payment terms are governed by the Client Service Agreement.
7. Payment Terms

All services must be paid for in accordance with the invoice due date.

Late payments may result in temporary suspension of services.

No refunds are provided for completed or attempted checkups.
-
Multi-month packages are billed in advance and non-refundable once services begin.
8. Cancellations and Rescheduling
8.1 Regular Checkups
Cancellations made at least 48 hours in advance may be rescheduled without penalty.
Cancellations made with less than 48 hours’ notice count as a completed visit.
8.2 Emergency Requests
Emergency visits cannot be canceled once dispatched.
9. Liability and Indemnification
9.1 Limited Liability
TrueView Nayarit is not responsible for:

Pre-existing property damage

Theft, vandalism, or burglary

Weather-related or natural deterioration
-
Issues that develop between visits
-
Failures of third-party systems (internet, utility, alarms, cameras, etc.)
Our role is observational. We do not guarantee property preservation or prevention of loss.
9.2 Client Indemnification
Clients agree to indemnify and hold the Company harmless from any claims resulting from:

Inaccurate information provided by the client

Unsafe property conditions
-
Misuse of reports or photos
-
Third-party access arranged by the client
10. Reporting and Documentation
All checkup reports, photos, and videos are provided digitally.
Reports reflect the property’s condition at the time of the inspection only.
Documentation is for informational purposes and does not constitute certification, appraisal, or legal evidence unless required by authorities and explicitly acknowledged by the Company.
11. Privacy and Data Handling
Property photos, videos, and communication logs may be stored securely for service continuity, internal quality assurance, and legal protection.
We do not sell or share client information with third parties except when:

Required by law

Necessary for emergency response

Explicitly requested by the client

12. Termination of Services
We may terminate services if:

Access is repeatedly unavailable
-
Safety concerns persist
-
Payments are overdue
-
Client behavior is abusive, deceptive, or creates unreasonable demands
-
The scope of work regularly exceeds normal operating parameters
Clients may terminate services with 30 days’ notice unless bound by a pre-paid term.
13. Amendments
We may update these Terms periodically to reflect operational changes. Updates take effect upon publication on the Company website. Continued use of services constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of the State of Nayarit and applicable federal laws of Mexico. Any disputes shall be resolved in the corresponding jurisdiction.
